Credit Reporting Policy

In certain circumstances, Cleanway Group Pty Ltd (ACN 645 125 766), Cleanway Environmental Services Melbourne Pty Ltd (ACN 169 901 393); and Envirochoice Industries Pty Limited (ACN 125 638 164) and its Australian subsidiaries and affiliates (Cleanway Group, we, us, our) may be a credit provider under the Privacy Act 1998 (Cth) (Privacy Act). As a credit provider, we must comply with Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code 2025 (CR Code) when we collect, use, hold, disclose or handle credit information, credit eligibility information or credit reporting information (as each of those terms are defined in the Privacy Act, together referred to as Credit Related Personal Information).

This Credit Policy sets out how we manage, Credit Related Personal Information; and sets out our statement of notifiable matters that we must make you aware of before we disclose your personal information to a Credit Reporting Body (CRB).

The Privacy Act and CR Code set out strict rules on how we can handle your personal information that relates to credit. This is because this information is important to you and impacts decisions on whether credit providers give you credit. We recommend you read this document carefully as it contains important information about how we handle your Credit Related Personal Information, including notifiable matters that we must make you aware of under the CR Code.

  1. Why do we collect, hold, use and disclose Credit Related Personal Information?
    We may collect, hold, use and disclose Credit Related Personal Information to assess your credit situation when you seek to obtain goods or services from us under our credit application terms and conditions. We primarily collect and use Credit Related Personal Information to assist us to decide whether it is appropriate or sensible, based on your credit worthiness, to approve your application for a credit account.KEY DISCLAIMER: We may use and disclose your personal information to make information requests to CRBs in connection with your application for commercial credit. Your consent is not required to make an information request. However, you should be aware that a record of the information request may be used and, as relevant, disclosed for the purposes of the CRB or a credit provider assessing the individual’s credit worthiness, including calculation of a credit score or credit rating (subject to any other use or disclosure limitations under the Privacy Act, the CR Code or other privacy regulations). This request will be recorded as a ‘credit enquiry’ on your credit report and may affect your credit score or credit rating that is calculated by a CRB.  If you apply for credit in the future, other credit lenders may be able to see our credit enquiry and our inquiry may negatively impact your credit score. If you commit a serious credit infringement, we may also be entitled to disclose this to a CRB.We may also collect, hold, use or disclose Credit Related Personal Information to:

    • conduct credit checks and obtain information from a CRB or credit provider regarding or relating to your credit worthiness:
      • to assess your commercial credit application; or
      • to assess your suitability as a guarantor in favour of an applicant or customer of a credit facility, and if we proceed, establishing and managing the credit facility you have guaranteed;
    • service and administer your account with us, including to manage the commercial credit provided by us to you, and consider any request to increase your credit limit;
    • contact you (including by way of email) in response to your enquiries about your credit application or the guarantor process or our products and services; 
    • maintain and update our records of information you have provided us (including by way of a credit application form);
    • undertake our debt recovery activities, if you fail to meet your payment obligations;
    • undertake a registration of security interests (for example, on the Personal Property and Security Register); 
    • send you information including by way of direct marketing about other products or services that we think might be of interest to you – you can opt out at any time by using the unsubscribe facility in the messages we send you, or by contacting us in accordance with our Privacy Policy; 
    • comply with our obligations under the Privacy Act, the CR Code and any other laws, including our complaint handling obligations; and 
    • otherwise conduct our ordinary business functions and activities
  2. What kinds of Credit Related Personal Information do we collect and hold?
    We may collect and hold the following types of Credit Related Personal Information directly from you or from a CRB or other credit provider where this is permitted in accordance with the Privacy Act: 

    • your name, address date of birth, and driver’s licence number;
    • the fact that you have applied for commercial credit from us, the amount, and that we are a current credit provider to you;
    • the fact that you have provided a personal guarantee for a customer in connection with its Credit Application and the amount;
    • the status of outstanding payments that you owe to us, including whether they are overdue and when overdue amounts are paid;
    • that we have implemented debt recovery action;
    • advice that your payments are no longer overdue in respect of any default that has been listed;
    • our opinion, or the opinion of another credit provider, that you have committed a serious credit infringement (such as acting fraudulently to obtain credit);
    • publicly available information about you relating to your activities in Australia or credit worthiness, such as information available via publicly accessible databases and annual reports;
    • information about a credit-related judgment against you in (non-criminal) proceedings in an Australian court; 
    • personal information provided to us by a CRB that may have a bearing on your credit worthiness; 
    • any administrative information relevant to managing our relationship with you; and
    • any other information permitted to be included in a commercial credit information file under the Privacy Act.

    We will generally collect Credit Related Personal Information directly from you.  For example, we may collect this information as part of a credit application made by you or your company to obtain information about you for a commercial credit related purpose (such as assessing your credit application).  We may also derive Credit Related Personal Information from our interactions with you and in managing your account.

    We may also collect this information from CRBs and other credit providers, to the extent this is permitted by the Privacy Act. This may include information about your previous credit checks, any problems you have had paying bills and whether those issues were resolved.

  3. Who do we disclose Credit Related Personal Information to?
    We may disclose your Credit Related Personal Information to CRBs and other credit providers, but only when permitted to do so by the Privacy Act. We have set out in the table below who we may disclose your Credit Related Personal Information to and why.

    Credit Reporting Bodies (CRBs) We may disclose Credit Related Personal Information to CRBs when seeking information from them about your credit worthiness The CRB(s) that we usually disclose credit information to are as follows:

    • Creditor Watch. You can obtain a copy of Creditor Watch’s policy about the management of Credit Related Personal Information on its website at (www.creditorwatch.com.au).  Creditor Watch has an Australian link.

    You have the right to request that Creditor Watch or any other CRB that we may make you aware of, from time to time, does not use your credit reporting information for the purposes of pre-screening or direct marketing by a provider and not use or disclose your credit reporting information if you believe on reasonable grounds that you have been or are likely to be a victim of fraud.

    The CRB may include this information in reports provided to credit providers to assist them to assess the individual’s credit worthiness;

    Credit Providers We may disclose Credit Related Personal Information to other credit providers to whom you have had consumer or commercial credit dealings. We may do this to notify other credit providers of a default by you; and to exchange information with other credit providers as to the status of your credit arrangements where you are in default with other credit providers.
    Debt collectors We may disclose Credit Related Personal Information to debt collectors for the purpose of collecting payments that are overdue in relation to your commercial credit.

    We may disclose Credit Related Personal Information to an entity in circumstances where we assign or otherwise sell your debt to that third party.  

    Our related bodies corporate We may disclose Credit Related Personal Information to our related bodies corporate. This includes Cleanway Group Pty Ltd, Cleanway Environmental Services Melbourne Pty Ltd; and Envirochoice Industries Pty Limited.
    Other parties We may disclose Credit Related Personal Information to any other parties, where required or authorised by or under Australian law, such as Government and law enforcement bodies.
  4. How do I access, correct, or make a complaint about the handling of my Credit Related Personal Information?
    You can access any Credit Related Personal Information we hold about you, ask us to correct it, or make a complaint about our compliance with the Privacy Act or CR Code by contacting us using our contact details in Section 6 below.However, we must take reasonable steps to verify your identity before granting you access to Credit Related Personal Information and we may need to cite evidence to support your request for access, such as a copy of your drivers licence or passport or other documents that will confirm your identity to our reasonable satisfaction.If we agree that our records regarding your Credit Related Personal Information need to be corrected, and we have previously disclosed that information to a CRB or other person, we will tell them about the correction.  We will generally provide access and resolve correction requests within 30 days of a request, unless unusual circumstances apply (including where we have been unable to verify your identity). However, once we determine that a correction should occur, we will make this correction following making that determination within a reasonable period of time.

    If you complain to us about our conduct regarding our handling of your Credit Related Personal Information, we will acknowledge your complaint within 7 days and will then investigate and decide how to deal with your complaint within 30 days.  If you are not satisfied with our management of your complaint you may complain to the Office of the Australian Information Commissioner (OAIC).
